ACCEPTANCE OF TERMS OF USE
This constitutes an agreement between you and 9381-9506 Québec inc. ("VOSKER") regarding your purchase of VOSKER cameras and accessories ("Products") available on the VOSKER Services.
VOSKER provides the Products subject to these Terms of Use, the rules, policies and guidelines for the Products, and the following terms (collectively, and as may be modified from time to time, the "Terms"), which are an integral part of this Agreement and govern your use of the Plans:

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THE VOSKER SERVICES.
You may purchase Products with your VOSKER account or with a guest account if you do not have a VOSKER account. By making a purchase, you acknowledge and agree to these Terms of Use. If you choose not to accept these Terms of Use, you must refrain from using the VOSKER Services and refrain from making any purchases.
YOUR ORDER
If you are an ordinary consumer, your purchase through the VOSKER Services will constitute a legally binding contract between you and VOSKER in accordance with applicable statutory laws granting you rights.
If you are a business customer (a retailer, distributor, or consumer using the Products for commercial purposes or professional activities), your purchase on the VOSKER Services will constitute a legally binding distance contract between you and VOSKER, subject to the requisite adjustments concerning your status as a merchant.
The remote purchase of certain products may be subject to a minimum order quantity. Where applicable, you will be notified when placing your order.
VOSKER will confirm your purchase by email, including the transaction details, within a reasonable timeframe.
No amendments can be made once your order has been submitted. VOSKER reserves the right, at its sole discretion, to require additional verification or information before accepting any order, or to cancel or refuse any order for any reason whatsoever, including (i) limiting the quantity available for purchase; (ii) inaccuracies or errors in the pricing information displayed on the VOSKER Services; or (iii) VOSKER's inability to obtain confirmation of authorisation to charge your payment method.
PRICE
You will pay VOSKER's listed price for each Product or Service, as indicated on the Platform. The prices displayed are in the currency of the country in which you reside or to which your purchase will be delivered.
The final amount will include applicable taxes in your territory and all taxes (T.T.C.), including VAT at the standard rate in effect and any applicable environmental surcharge. Delivery charges or other options for your purchase will be communicated to you prior to final purchase and will be included on your receipt or invoice. Delivery costs may vary depending on the value of the goods.
VOSKER reserves the right to require a minimum purchase amount for an order to qualify for free delivery. Free delivery only applies to orders that meet the minimum amount and the specified conditions. Where applicable, the minimum threshold to be met will be communicated to you before finalising your purchase. This threshold is subject to change at any time without prior notice.
The prices of our Products are subject to change without prior notice. VOSKER is not liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.
PAYMENT METHOD
VOSKER will charge and collect full payment from you for the Products or Services that are the subject of your order upon receipt of such order.
VOSKER may store information about the payment methods you use for your Product purchases. VOSKER may make this information available to you to enable you to make payment for other purchases of products or services that you may purchase through the VOSKER Services.
DELIVERY
VOSKER will deliver each order of goods in accordance with the delivery method offered at the time of purchase and the delivery address you have specified during your online purchase. All stated delivery times are estimated, and VOSKER cannot be held liable for any delivery delays. VOSKER may entrust the delivery services to a third-party service provider.
VOSKER's primary obligation is deemed fulfilled if VOSKER attempted to fulfil it on the date specified in the order confirmation or on the date specified in a notice sent to you within a reasonable period, but was prevented from doing so due to your actions or negligence.
It is noted that, in accordance with the applicable law, any sales contract where the delivery of the goods is not immediate may be terminated by the consumer if the date or period indicated to them has been exceeded, and if, after having ordered VOSKER to make the delivery within a reasonable additional period, VOSKER failed to do so. The sales contract may also be immediately terminated by the customer in the event of VOSKER's refusal of delivery on the agreed date, or upon the expiry of the additional period as mentioned above, if such date or period constitutes an essential condition of the contract for the consumer.
VOSKER will remain liable for any damage, loss, or defect in the goods until they are delivered to you, whereupon you will assume sole responsibility.
PURCHASE LIMITS AND ORDER TERMINATION BY VOSKER
VOSKER reserves the right, but is under no obligation, to limit or restrict sales of the Products or Services to any person, geographical region, or jurisdiction. This right may be exercised on a case-by-case basis.
VOSKER reserves the right to limit the quantities of any Product or Service offered and to refuse any order. Any offer of a Product or Service made on the VOSKER Services is void where prohibited by law.
VOSKER does not guarantee that the quality of any Product, Service, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be rectified.
REFUNDS, CANCELLATIONS AND EXCHANGES
VOSKER does not offer any refunds, other than to Consumers who have a right of withdrawal in accordance with applicable law.
You may, within thirty (30) days of purchasing a Product, request an exchange for another Product of the same or higher value by paying the difference in price. Should you choose a Product of lesser value, VOSKER will not refund the difference between the higher initial price and the purchase price of the replacement Product.
To complete your exchange, VOSKER requires a receipt or proof of purchase issued by VOSKER. You must contact VOSKER in order to obtain a Return Merchandise Authorisation (RMA) number. To be eligible for an exchange, your Product must be unused and in the same condition in which you received it. Otherwise, VOSKER may refuse the return and dispose of the Product.
Under no circumstances will VOSKER accept returns for which delivery charges must be paid upon receipt. Such consignments will be refused upon receipt and returned to the sender. You are responsible for any loss or damage to the material during delivery. We do not guarantee that we will receive your returned item. Delivery and handling fees are non-refundable.
RIGHT OF WITHDRAWAL (applicable to European consumers)
This section applies only to consumers residing in Europe or any other territory if required by applicable law.
You have a right of withdrawal which runs from the date of your purchase and which can be exercised within fourteen (14) business days of the date of receipt of your order. This right allows you to withdraw without having to justify your reasons or pay any penalties except for the cost of returning the product. You can contact us or follow the suggested procedure here.
In the event of exercising your right of withdrawal, VOSKER will refund your entire order (products + initial delivery costs). However, you will not be refunded for any additional costs arising from the choice of a delivery method that is more expensive than the original delivery method.
The refund is always made to the original method of payment used at the time of purchase. The Product(s) that have benefited from a price reduction via a promotional code or other form of discount will be refunded up to the price actually paid by the customer. Vouchers and discount coupons are non-refundable.
The refund will be processed within the timeframes provided by applicable law once VOSKER receives proof of dispatch or confirmation of the return of the products by the carrier.
In accordance with applicable regulations, in the event of damage or traces of wear and tear on the returned products resulting from handling beyond what is necessary to establish the nature, characteristics and proper functioning of these products, VOSKER may reduce the refund amount accordingly.
FORCE MAJEURE
VOSKER cannot be held liable for any breach, even partial, or a delay in the performance of its contractual obligations that would result from the occurrence of a force majeure event or that is attributable to a regulatory or legislative act.
WARRANTY
VOSKER offers a two (2) year warranty on cameras and other transmission devices sold and a one (1) year warranty on all other products sold, including accessories.
Visit the VOSKER Services to view your Product's instruction manual. In the event of any discrepancy between these Terms and the instruction manual, the information in the instruction manual shall prevail. No warranty will be given on any Product that has suffered physical damage. Any Product must be carefully inspected by one of our agents before an RMA is issued for warranty return.
DISPUTE RESOLUTION AND LIMITATION OF LIABILITY
Any dispute or claim arising out of or relating to these Terms and the Subscription Terms is subject to the dispute resolution provisions, applicable laws, disclaimer of warranties and limitation of liability and all other terms and conditions of the VOSKER Terms of Service.
